Cycling Liability Release and Assumption of Risk Form
WARNING:
PLEASE read carefully before signing; activity waivers have held up in Canadian courts. Consider that you are assuming both physical and legal risks which have potential financial implication for yourself and/or your family should you be injured or killed while participating in an ADVENTURE HIGH INC. activity.
I acknowledge that I have voluntarily applied for enrollment in the below listed ADVENTURE HIGH INC. activity, and in consideration of being permitted to rent, do voluntarily execute this "Liability Release and Assumption of Risk" on behalf of myself, my heirs and next of kin, my personal representatives and my estate.
That I hereby acknowledge that certain risks of injury and unforeseeable environmental hazards are inherent to bike and bike trailer rentals. These injuries could be minor or serious and may result from one's own and/or others actions or inaction's. By acknowledging these specific risks I agree to personally assume such risks. I also agree to wear a Protective Device (helmets are mandatory in the province of New Brunswick) at all times. I also understand and agree to test ride said bike/bike trailer and inform ADVENTURE HIGH INC. of any problems, concerns and/or safety issues prior to renting.
I also acknowledge that cycling can be physically strenuous activity and requires physical fitness and good health.
I declare that I am in good physical and mental health. I believe that I am able without reservation to participate in all ADVENTURE HIGH INC. activities that I am enrolled in. I agree to inform ADVENTURE HIGH INC. of any medical/mental concerns applicable to my participation in any/or all ADVENTURE HIGH INC. activities. I hereby authorize the leader of the activity to secure such medical advice and services as may be deemed necessary for the health and safety of myself, my child or other in the group and I agree to accept any financial responsibilities. Please list any concerns medical or other wise that could affect your participation in ADVENTURE HIGH INC. activities.
I agree to abide by the rules and regulations imposed on participants by ADVENTURE HIGH INC. and its staff. These rules and regulations are designed for the safety and protection of all participants.
I hereby release ADVENTURE HIGH INC. its officers, employees, servants and agents from any liability with respect to any damage and/or injury (including death) that I may suffer during my participation in these activities except where the damage or injury is caused by the gross or wilful negligence of ADVENTURE HIGH INC. its officers, employees, servants and agents acting within the scope of their duties.
I further state that I am of sufficient age and mental capacity to sign this liability release, or that I have acquired consent of my guardian.
I further agree that the equipment that I rent will be returned and in the same condition as rented.
My signature below indicates that I have read and understand the above Liability Release and Assumption of Risk Form in its entirety and hereby consent to participate in ADVENTURE HIGH INC. activities.
